Recording Requirements

Before submitting a document for recording, please review the requirements below to avoid delays or rejection.

Document Requirements
• Original document is required for recording  
• All signatures must be included  
• Names should be clearly printed or typed beneath signatures  
• Document must be legible and suitable for scanning  and copying

• Minimum 3-inch margin at the top of the first page

About the Fee Schedule

45-215. Title of act. K.S.A. 45-215 through 45-223 shall be known and may be cited as the open records act                                                 

K.S.A. 45-218(f). A public agency may charge and require advance payment of a fee for providing access to or furnishing copies of public records subject to K.S.A. 45-219 .

K.S.A. 45-219(c). Each public agency may prescribe reasonable fees for providing access to or furnishing copies of public records, subject to the following:

  1. In the case of fees for copies of records, the fees shall not exceed the actual cost of furnishing copies, including the cost of staff time required to make the information available.
  2.  In the case of fees for providing access to records maintained on computer facilities, the fees shall include only the cost of any computer services, including staff time required.

Military Discharge Records (DD214)

The Ness County Register of Deeds would like to remind the public that Veterans can record their Military Discharge or DD214 form for FREE.

Why should I file my DD214 with the Register of Deeds Office?We encourage you to file your DD214 because this document is essential in proving your veteran status. Having a discharge recorded will enable Veterans to receive certified copies to present to the Veterans Administration when applying for benefits or as proof of military services when applying for a job. Certified copies are as good as the original and once filed, will always be available in the event that the original is lost or destroyed.

How do I file my DD214?

Bring the original Member-4 document to our office. You will receive your filed original document and five certified copies.

Can anyone access my DD214 once I file it in your office?
No, but with a completed DD214 Form Request the records can only be released to: service member, service member’s immediate blood relative OR married spouse, married spouse OR un-remarried widow/widower, children, siblings, parents, grandparents, other lineal descendent, licensed funeral director.

Pursuant to K.S.A. 2014 Supp. 45-221(a)(46) regarding the Kansas Open Records Act, Military Discharge (DD214) Records are exempt from being open to the public. Access to said records is restricted to the dischargee, his/her descendants or agents.

How do I get a copy of my DD214?
Complete and sign a DD214 Form Request and mail it to our office with a legible copy of your driver’s license. The completed form must be sent to us via mail. We cannot accept request forms via fax or e-mail. You may come to the office in person and fill out a request form and we will retrieve and certify five copies for you.

KSA 73-210 requires the Register if Deeds to only fileoriginal or certified copiesof Military Discharges. If you have lost your original DD214, you can request a duplicate from the National Personnel Records Center.

Frequently Asked Questions

Can I get forms from the ROD Office for my use?

The only form we have available is the Kansas Sales Validation Questionnaire.

Should I record my military records (DD-214, etc.) with the ROD Office?

Yes, there is no charge to our veterans to record any military papers. We recommend recording the DD-214 for safe keeping. *These records are not open for public inspection.

When should a death certificate be filed in the ROD Office?

When an individual dies and is listed as an owner of record, a certified copy of the death certificate should be filed. We must have one of the original certified copies from the State that has issued the certificate.

Who runs the ROD Office?

The ROD Office is administered by a duly elected official called the Register of Deeds, who in turn, has a Deputy Register of Deeds that perform various duties within the office.

Can the ROD Office help me find records of my ancestors?

If they owned land in Ness County, probably.

How far back do the records go?

The earliest records found in our office date back late 1800’s. Among the early records are the patent deeds recorded when land was bought by the U.S. Government and are signed by some of our early presidents.

What other kinds of records will I find in the ROD office?

Besides deeds, mortgages, and liens, we have land patent books, old county Atlas books, oil and gas leases, plats of additions to the towns and subdivisions in Ness County, county school’s records and teacher records, along with honorable military discharges from the armed services, and powers of attorney. *Not all records in the ROD office are open to the public.

What is uniform Commercial Code?

Uniform Commercial Code, more commonly known as UCC, became effective in Kansas in 1966. As the name implies, a code developed for uniform filing on all personal property. The filing of UCC financing statements is what perfects or secures the loan on consumer goods or personal property.

Can I locate the mortgage on my house in the ROD office?

Yes. Normally the mortgage follows the recording of the deed. If not, then we would go to our tract index for that piece of property and find the mortgage that way. The index will give you the book and page and recording information of your mortgage.

Can the ROD office tell you if you have a good & clear title to your property?

No. Professional title examiners or abstractors use the records in our office, along with their own records and records of other offices to determine if the title is good and clear.

Can you record property in the Ness County ROD Office if the property is not located in Ness County?

No. The property must be in Ness County

May I make out my own deed?

Yes, you could, but the R.O.D. Office always recommends the retention of an attorney, licensed abstractor of a land title company. We are a recording agency and cannot make out deeds or answer those questions which pertain to legal matters.

How long does it take for a document to be recorded?

Most documents are completed and returned within 2-4 business days unless problems occur during processing.

What if I lose my deed?

If your deed is misplaced or lost, a copy may be obtained from the R.O.D. Office and certified with its official stamp.

Should a deed be recorded with the ROD Office?

Yes. A deed should be recorded as promptly as possible after the transaction. Failure to record a deed could render the transfer or mortgaging of the property impossible and create numerous legal difficulties.

What happens to a document when it is brought into the ROD Office?

There are several steps taken when an original document is brought or mailed in to be recorded before it is returned to the concerned party. First, the document is evaluated for obvious errors and recordability and the correct fee is ascertained. Then a book and page number are assigned to each page. Once the document has been copied, imaged, and indexed it is returned.

What is the Register of Deeds Office (ROD)?

The R.O.D. Office is a place where all transactions having to do with land, including deeds, liens, and mortgages are recorded and maintained so that the public is made aware of their existence. This is also the place where financing statements and security agreements are filed on personal property and the Uniform Commercial Code (U.C.C.).
